Cílem této diplomové práce je popsat a rozebrat legislativní proces dle francouzské ústavy ze 4. října 1958. Tento legislativní proces představuje unikátní a modelové řešení ústavních vztahů. Obsahuje řadu specifických prvků, které jsou zcela odlišné od české úpravy, a proto si proces zasluhuje podrobnou analýzu. Velkou zvláštností je především omezení legislativní pravomoci Parlamentu, na jehož základě může Parlament přijímat zákony pouze v oblastech stanovených ústavou. Unikátní je také vzájemný vztah a postavení obou komor Parlamentu při přijímání zákonů, kdy jako obecné pravidlo platí rovné postavení obou komor. Legislativní proces je charakteristický dominantním postavením vlády, která disponuje ústavními nástroji, jimiž ovlivňuje výsledné znění zákona. Aktuální podobu legislativního procesu ovlivnila svojí rozhodovací činností Ústavní rada. V legislativním procesu sehrává určitou roli i prezident republiky, jíž se budu také věnovat. Toto jsou základní charakteristiky legislativního procesu upraveného francouzskou ústavou ze 4. října 1958, které analyzuji na základě francouzské a české odborné literatury a nejdůležitějších rozhodnutí Ústavní rady. Také se zamýšlím nad hlavní problémy a mezerami této úpravy a prezentuji způsoby jejich řešení.The aim of this thesis is to describe and analyse the law-making process according to the French Constitution from 4th October 1958. This law-making process represents the unique and model solution of constitutional relations. It includes many specific elements, which are completely different from the Czech version of law-making process. That is why it deserves detailed analysis. The great rarity is the restriction of Parliament's legislative competence. This is the reason why the Parliament approves only laws in the spheres defined by Constitution. The mutual relation and position of both chambers of the Parliament is unique, too. The general rule is the equal position of both chambers in the law-making process. The law-making process is characterised by predominant position of the government, which has constitutional instruments for impacting the final version of law. The recent law-making process is influenced by decision-making activity of Constitutional Council. The president of the republic has his specific role. I will describe it as well. These are the main characteristics of the law-making process based on the French Constitution from 4th October 1958, which I analyse using French and Czech bibliography and most important decisions of the Constitutional Council. I reflect the main problems and gabs and I present the ways of their solution.
