Tato práce pojednává o vztahu mezi mezinárodní trestní spravedlností a mezinárodním mírem. Mezinárodní trestní spravedlnost je hodnotou, o kterou se opírá mezinárodní společenství, přesto stíhání nejzávažnějších zločinů na mezinárodní úrovni budí jisté politické kontroverze. Práce analyzuje vztah mezi RB OSN a MTS v otázkách výkonu jurisdikce Soudu a v této rovině se zabývá vlivem RB OSN na nezávislost stálého trestního tribunálu v Haagu. Práce se věnuje vztahu mezi výkonem mezinárodní trestní spravedlnosti a jednání RB OSN v režimu kapitoly VII Charty OSN a na případu dárfúrské kauzy a definování zločinu agrese zkoumá vliv politického rozhodnutí Rady na výkon mezinárodní trestní spravedlnosti.This thesis is a one policy-issue study of relations between the United Nations Security Council (hereinafter the UNSC) and the International Criminal Court (hereinafter the ICC, the Court) with special focus on the UNSC influence on the Court jurisdiction. The research question concerns whether the UNSC power to influence the Court jurisdiction tackles the first permanent international criminal court´s independence. The study analyses execution of international criminal justice and activities of the UNSC within the Chapter VII of the UN Charter. Additionally, it examines the UNSC political influence on the Court jurisdiction in two analytical cases: the O. al-Bashir case and the definition of the crime of aggression case. Furthermore, this study aims at presenting context between international criminal justice and international peace.
