Tato diplomová práce s názvem "Problémy legislativního procesu" je zaměřena na proces přijímaní zákonů v naší republice s důrazem na nedostatky, které se v praxi objevují. Celá práce je rozdělena na 7 kapitol. Pro lepší orientaci jsou kapitoly 2 - 6 rozděleny ještě na podkapitoly tak, aby se čtenář v textu neztratil. V úvodu jsou uvedeny důvody, které mne vedly k výběru daného tématu, a také její cíl. Tímto je rozbor problematiky obcházení legislativního procesu v ČR. Druhá kapitola je věnována zákonodárnému procesu v naší republice tak, jak je vymezen v Ústavě ČR, v Zákoně o Ústavním soudu, v Zákoně o jednacím řádu Poslanecké sněmovny, v Zákoně o jednacím řádu Senátu a Legislativních pravidlech vlády. V souvislosti s přijímáním zákonů je zde zmíněna i role prezidenta republiky, který zákon podepisuje. Třetí kapitola se zabývá největším problémem legislativního procesu, kterým je dle mého názoru jeho obcházení pomocí přílepků. Tato kapitola se snaží nejen vymezit přílepek v zákoně, ale také upozorňuje na rozpor mezi takto přijatým zákonem a jeho názvem. Svá tvrzení a zjištění opírám o odborné názory, se kterými jsem se při studiu této problematiky setkala. V neposlední řadě se v této souvislosti zmiňuji i o roli Ústavního soudu. Kapitoly 4 a 5 jsou zaměřeny na dva zásadní nálezy Ústavního soudu, konkrétně jsou to nálezy sp. zn. Pl. ÚS 77/06 a sp. zn. Pl. ÚS 24/07, ve kterých Ústavní soud definoval termíny "pozměňovací návrh" a "přílepek" tak, aby zákonodárci, odborná veřejnost, ale i laici byli schopni rozpoznat, ve kterých případech se jedná o přílepek k zákonu a ve kterých se jedná pouze o pozměňovací návrh. Ústavní soud se při tomto inspiroval zejména v USA. V těchto kapitolách jsem se snažila nejen o komparaci uvedených dvou nálezů, ale v mnoha případech jsem připojila i svůj názor. V šesté kapitole jsou uvedeny některé z mnoha konkrétních příkladů přílepků, s nimiž jsem se při psaní této práce setkala. Jednotlivé přílepky jsou zde nejen vyjmenovány, ale některé jsou i detailně rozebrány. K některým z uvedených příkladů jsou připojeny i komentáře zákonodárců. V závěru celé diplomové práce se vyjadřuji k současným snahám politiků zabránit obcházení legislativního procesu pomocí přílepků.This thesis, entitled "Problems of the legislative process" is focused on the process of passive laws in our country with emphasis on the deficiencies that appear in practice. The whole thesis is divided into 7 chapters. For better orientation and reader´s clarity the chapters 2 - 6 are divided into the subsections . My reasons for choosing the topic are mentioned in the introduction. There is also the target of the thesis which is the analysis of the issue to circumvent the legislative process in the Czech Republic. The second chapter is devoted to the legislative process in our country as it defined in the Constitution of the ČR, in the Law of the Constitutional Court, the Law of the Chamber of deputies, the Law of the Rules of Procedure of the Senate and the Legislative Rules of the Government. In connection with passive laws the role of president who signs the law mentioned is there. The third chapter deals with the biggest problem of the legislative process, which is in my opinion, its circumvention by "wild riders". This chapter tries to define not only "wild riders" in the law, but also draws attention to the contradiction between this law and its name. My claims and findings are based on experts opinions which I found out during the study of this issue. Finally, in this context, I also mentioned the role of the Constitutional Court. Chapters 4 and 5 focus on two major judgments of the Constitutional Court. This is concerning judgments sp. zn. Pl. ÚS 77/06 and sp. zn. Pl. ÚS 24/07. In these judgments Constitutional Court has defined the terms "legislative riders" and "wild riders" so the legislators, professional public as well as laymen were able to identify cases in which it is "wild rider" to the Law and in which it is only "legislative rider". In this issue the Constitutional Court of was particularly inspired by the USA . In these chapters I have not only tried to compare these two findings, but in many cases I have added my own opinion too. The sixth chapter describes some of the many specific examples of "wild riders" that I met during writing my thesis. Individual "wild riders" are named in this chapter and some of them are also discussed in detail. The comments of lawmakers are attached to some of these examples. At the end of the whole thesis I comment on the current efforts of politicians to prevent circumvention of the legislative process with "wild riders".
