Předmětem této diplomové práce jsou trestně právními aspekty domácího násilí, které se stalo fenoménem dnešní doby. V úvodu se práce věnuje zejména definování pojmu domácí násilí a násilí obecně. Na závěr úvodní části je objasněno, kdo je pachatelem, proč dané skutky páchá, a kdo je jeho obětí, a jaké následky ji svým jednáním způsobuje. Dále práce blíže definuje jednotlivé znaky skutkové podstaty trestného činu. V další části práce je podrobně vysvětlena legislativní úprava domácího násilí v ČR, možnosti trestního postihu pachatele. Pro srovnání práce popisuje i možnosti postihu a řešení domácího násilí orgány činnými v trestním řízení v Rakousku a v Nizozemí a navrhuje změny v české právní úpravě de lege ferenda.The thesis is focused on criminal aspects of domestic violance which has become a phenomenom of this time. In the introduction the work is mainly dedicated to a general definition of a term domestic violence and generaly violance as the basic point. The concluding part of the mening section explains who the offender is, why he commits the given acts and who is victim and chat the consequences caused by his acts are for the victim. Further, the work defines merits of the crime. In the next part of the work is the detailed explanation of a home violance legal regulation in the Czech Republic, possibilities of criminal penalties for the offender. The work puts forward for comparison also the possibilities of criminal penalty and solutions of domestic violence made by criminal suit authorities in Austria and Netherlands and deals with the possible future changes of Czech legal form.
