    Aktuálne problémy práva zhromažďovacieho v Českej republike a na Slovensku [rukopis] / Miroslava Jaššová. -- 2011. -- Oponent Michal Bartoň. -- Ved. práce Jiří Jirásek. -- Abstrakt: Táto diplomová práca sa zaoberá aktuálnymi problémami práva zhromažďovacieho v Českej republike a na Slovensku. V úvode je stručne rozobraná história práva zhromažďovacieho na území oboch štátov od vzniku prvej Československej republiky v roku 1918 až po prijatie zákona č. 84/1990 Zb. o práve zhromažďovacom v roku 1990, kedy v Českej republike a na Slovensku konečne nastala skutočná sloboda zhromažďovania v zmysle súčasnej medzinárodneprávnej úpravy. Nasledujúca kapitola upravuje stručnú charakteristiku zhromažďovacieho práva a jeho základných znakov, nasledujú pramene zhromažďovacieho práva v Českej republike i na Slovensku ? medzinárodné dokumenty, ústavné predpisy i zákonné predpisy s krátkym komentárom a konečne kapitola o zákone o práve zhromažďovacom a jeho aktuálnych problémoch. V podkapitolách sú stručne popísané jednotlivé inštitúty spolu s ich významom, problémami v praxi a následným riešením orgánmi súdnej moci, ústavnými súdmi oboch štátov a Európskym súdom pre ľudské práva. Na záver je kapitola o ďalších problémoch súvisejúcich s právom zhromažďovacím, ktoré nebolo možné zaradiť do predchádzajúceho textu. Právo zhromažďovacie v oboch štátoch spočíva na oznamovacom princípe v súlade s ústavnými predpismi oboch štátov. Tento princíp je doplnený inštitútom zákazu zhromaždenia v zákonom stanovených prípadoch, ktorý Najvyšší správny súd v Českej republike doplnil zásadou, že v prípade dôvodnej obavy, že účel zhromaždenia uvedený zvolávateľom v oznámení zhromaždenia je odlišný od účelu zvolávateľom skutočne zamýšľaného a u ktorého by bol daný zákaz zhromaždenia, na základe viacerých indícií a dôkaznému bremenu úradu je možné takéto zhromaždenie ?preventívne? zakázať. Práca sa tiež zaoberá právami a povinnosťami zvolávateľa i účastníkov zhromaždenia a úlohou úradov pri poskytovaní ochrany tomuto právu, medzi ktoré patrí najmä povinnosť zabezpečiť ochranu zhromaždeniu, jeho pokojnému a riadnemu priebehu, účastníkom zhromaždenia i ostatným osobám, ktorých práva a slobody môžu byť výkonom zhromažďovacieho práva dotknuté. Nesprávnym nastavením právnej úpravy práva zhromažďovacieho môže dochádzať k tzv. chilling effectu, ktorého dôsledkom je odradenie potenciálnych zvolávateľov zhromaždenie zvolať, alebo potenciálnych účastníkov zhromaždenia sa účastniť. K uplatňovaniu práv by malo dochádzať bez obavy pred možnými nežiadúcimi následkami či už vo forme fyzického útoku od osôb zastávajúcich odlišný názor, alebo pocitu, že výkonom tohto práva sa ?aj tak nič nezmení? a že konanie zhromaždenia a verejné prejavovanie názorov aj tak nemá zmysel. Toto všetko má za následok nechuť ľudí zhromažďovať sa a verejne sa podielať na správe vecí verejných, čo je javom v demokratickej spoločnosti pri ?vláde ľudu? nežiadúcim.. -- Abstrakt: The diploma thesis is dealing with current problems in the field of law of the right of assembly in the Czech Republic and in Slovakia. At the outset of the thesis, the brief conspectus of the history of law of the right of assembly, at the territory of both In case the legal regulation concerning the right of assembly is not properly set up, it may cause so called "chilling effect", which may results in discouragement of potential conveners to convene the assembly, or in discouragement of potential participants to take active part at the assembly. Rights should be claimed without a fear of undesirable consequences, no matter if these are in the form of physical attack from persons maintaining different opinion, or if these evoke the feeling, that it is useless to exercise such right, because "nothing is going to change" and that assemblies and public manifestation of opinion has no sense. All the things mentioned above lead in the aversion of people to assemble and to participate publicly in administration of public matters, which is, what is undesirable in a democratic society. abovementioned states from the formation of the first Czechoslovak state in 1918, up to 1990, when the bill No. 84/1990 concerning the right of assembly was enacted, is provided. It must be pointed out that the real freedom of assembly within the meaning of current international legal regulation occurred not earlier than after the bill No. 84/1990 had been enacted. The next chapter of the thesis briefly describes the right of assembly and its basic principles, the main sources of law of the right of assembly in the Czech Republic and in Slovakia, i.e. international documents, constitutional regulations and other legal regulations together with annotations and finally, the chapter concerned with law of right of assembly and its current issues. Chapters are consequently divided into sub-chapters, which briefly describes separate legal institutions together with their significance and problems which arise in practice and consequential solution brought by judicial and constitutional organs of both countries and by European Court of Human Rights. The chapter at the end of the thesis deals with other problems that occurs in connection with the right of assembly, or with the problems which because of their nature could not be placed in previous chapters. In both countries, i.e. in the Czech Republic as well as in Slovakia, the right of assembly is based on notification principle, which must be made in compliance with the constitutional regulation of each state. This main principle is then supplemented by the institution of prohibition of assembly in certain, by law provided cases. The Czech Supreme Administrative Court further supplemented the institution of prohibition of assembly in law provided cases by the principle, which states that in a case, where there is a reasonable belief that the true aim of the assembly differs from the aim stated in the notification, and that such aim would constitute the prohibition of the assembly if the true aim would be stated in the notification, there is a possibility to ban "preventively" such an assembly. The thesis also analyses the rights and duties of the convener of the assembly and of people taking active part at the assembly, as well as the role of specific authorities when providing protection to the right of assembly, inter alia, when fulfilling their duty to guarantee protection to the assembly ? to its peaceful and decent flow, protection to people taking active part in the assembly as well as other people whose rights and freedoms may be impaired by executing of the right.
