(95 928 znaků). -- Oponent Vendula Bryxová. -- Ved. práce Tomáš Tintěra. -- Abstrakt: Informovaný souhlas pacienta je pojmem medicínského práva, který legitimizuje zásah do tělesné integrity člověka. Je vyjádřením autonomie vůle jednotlivce a jeho práva na sebeurčení. Cílem této práce je analýza právní úpravy informovaného souhlasu v České republice a některých souvisejících aspektů. Tato práce je rozdělena do pěti hlavních kapitol. První kapitola je věnována vztahu mezi lékařem a pacientem a právní úpravě smlouvy o péči o zdraví v občanském zákoníku. V druhé kapitole nalezneme komplexní přehled vnitrostátní i mezinárodní právní úpravy informovaného souhlasu s důrazem na Úmluvu o lidských právech a biomedicíně, zákon o zdravotních službách, občanský zákoník a jejich vzájemný vztah. Kapitola třetí se zaobírá obsahem a náležitostmi informovaného souhlasu. Čtvrtá kapitola se týká osob, které jsou pro udělení souhlasu nezpůsobilé, a to buď v důsledku svého zdravotního stavu, omezené svéprávnosti nebo nezletilosti. Poslední kapitola je zaměřena na tzv. negativní revers (tj. písemné prohlášení či záznam o nesouhlasu s poskytnutím zdravotních služeb), jeho obsah a náležitosti. Dále jsou zde zmíněny situace, kdy souhlasu není třeba a řešena je také problematika udělování informovaného souhlasu či nesouhlasu za nezletilého pacienta s ohledem na nejlepší zájem dítěte.. -- Abstrakt: Informed consent of the patient is the concept of Medical Law, which legitimizes intervention to physical integrity of a human being. It is the expression of the autonomy of will of individuals and their right to self-determination. The aim of this study is to analyse the informed consent legislation in the Czech Republic and some related aspects. This thesis is divided into five main chapters. The first chapter is devoted to the relationship between doctor and patient and medical treatment agreement legislation in the Civil Code. In the second chapter we can find a complex summary of national and international informed consent legislation with an emphasis on Convention on Human Rights and Biomedicine, Health Services Act, Civil Code and their mutual relationship. Chapter Three deals with the contents and conditions of informed consent. The fourth chapter concerns with persons who are incompetent or unable to give consent themselves either because of their health condition, limited legal capacity or minority. The last chapter focuses on the negative reverse (i.e. written statement or record of refusal to provide medical services), its contents and requirements. There are also mentioned situations where consent is not necessary and the issue of granting informed consent or informed refusal for the minor patient considering the best interest of the child.
