Tato diplomová práce se zabývá manželstvím z pohledu Critical Legal studies. Cílem práce je zjistit, zda má být manželství zakotveno jako svazek muže a ženy či nikoliv. V práci je vysvětleno, proč má být manželství vnímáno jako právní konstrukt, a nikoliv jako posvátná instituce. Manželství je v práci porovnáno s registrovaným partnerstvím a práce se dále věnuje legitimním cílům a přiměřenosti odlišné právní úpravy mezi manžely a registrovanými partnery. Diplomová práce obsahuje i rozbor judikatury Ústavního soudu k otázce manželství osob stejného pohlaví.This thesis examines marriage from a Critical Legal Studies perspective. The aim of the thesis is to determine whether marriage should be enshrined as a union between a man and a woman or not. The thesis explains why marriage should be seen as a legal construct and not as a sacred institution. Marriage is compared to civil partnerships and the thesis further examines the legitimate aims and appropriateness of the different legal arrangements between married and civil partners. The thesis also includes an analysis of the case law of the Constitutional Court on the issue of same-sex marriage.
