Tato práce se zabývá transplantačním právem, posmrtným odběrem orgánů a tkání a jejich následnou transplantací. Představuje a vysvětluje jednotlivé modely vyvážení práv příjemce a dárce orgánů, analyzuje je a vzájemně srovnává. Řešeno je i případné pacientovo právo na transplantaci a také postavení pozůstalých osob a jejich možnost účasti na rozhodnutí o posmrtném odběru orgánů a tkání od zemřelého. Jedním z hlavních cílů práce je zvolit nejvhodnější model vyvážení práv příjemce a dárce orgánů, a to pomocí analýzy a srovnání jednotlivých modelů.This thesis is focused on the transplantation law, removal of organs and tissues and their following transplatntation after the death of donor. The thesis introduced and explains individual models of balance between the rights of the donor and those of recipient and it compares and analyses these two parties. The thesis also speaks of a patient´s right for transplantation and of the hierarchy of the bereaved ones and their possibility to take part in making the decision about the donation of the organs after the death of the deceased patient. One of the main aims of this thesis is to choose the most appropriate model of the balance of rights of the donor and the recipient of the organs by analysing and comparing individual models.
