(114 120 znaků). -- Oponent Pavel Petr. -- Ved. práce Václav Bednář. -- Abstrakt: Tato diplomová práce se zabývá problematikou ochrany nepominutelného dědice a instituty limitujícími jeho ochranu. Práce je rozdělena do čtyř kapitol. V první kapitole je vysvětleno, co je to institut nepominutelného dědice a kdo může mít takové postavení. Druhá kapitola se zabývá pořizovací volností zůstavitele a ochranou nepominutelného dědice. Je zde nastíněn historický vývoj vztahu dvou základních zásad dědického práva - autonomie vůle zůstavitele a zásady mezigenerační solidarity. Ve třetí kapitole jsem se zaměřila na ochranu nepominutelných dědiců, zejména na jejich právo na povinný díl. Ve čtvrté kapitole jsem představila několik institutů umožňujících zůstaviteli prosadit svou vůli v oblasti dědického práva. Cílem této práce je poskytnout ucelenou analýzu ochrany nepominutelného dědice a institutů limitujících jeho ochranu.. -- Abstrakt: This diploma thesis deals with the issue of protection of forced heir and institutes limiting his protection. The thesis consists of four chapters. The first one examines problematics of forced heirs - it answers the question who they are. Second chapter deals with the autonomy of the testator´s will and protection of forced heirs as it provides the historical background and development of the relationship between two basic principles of inheritance law - autonomy of the testator's will and intergenerational solidarity. In the third chapter I focused on their protection, especially on the forced share. In the fourth chapter I introduced several institutes enabling the testator to avoid the protection of forced heirs - disinheritance, donation mortis causa and testamentry trust. The aim of the thesis is to provide a comprehensive analysis of protection of forced heir and institutes limiting his protection.
