Tato diplomová práce se věnuje problematice výživného zletilého dítěte. Práce je systematicky členěna na dvě části. První část pojednává o hmotněprávní stránce vyživovací povinnosti rodičů k dítěti. Charakterizuje institut výživného, jeho subjekty, analyzuje obecná kritéria, která se vyskytují jak na straně oprávněného zletilého dítěte, tak povinného rodiče a ovlivňují rozsah výživného, dále se zaměřuje na negativní předpoklad pro přiznání výživného, kterým je posouzení souladu jednání oprávněného dítěte s dobrými mravy. Poslední kapitola je věnována trvání a zániku vyživovací povinnosti, přičemž se zaměří zejména na trvání vyživovací povinnosti v souvislosti se studiem a zdravotním stavem zletilého dítěte. Druhá část se zabývá procesně právní stránkou, tj. soudním řízením ve věci výživného zletilého dítěte, a to od podání žaloby přes průběh řízení v prvním stupni až po vydání rozhodnutí a následné hrazení nákladů řízení. Cílem diplomové práce je analýza institutu vyživovací povinnosti rodičů k dítěti, které již nabylo zletilosti a jednotlivých specifik s ní spojených, neboť této problematice není podle mého názoru v současnosti věnována taková pozornost jako je tomu v případě vyživovací povinnosti rodičů k nezletilému dítěti. Taktéž je cílem upozornit na problematické situace, které mohou nastat v souvislosti s trváním a zánikem vyživovací povinnosti, a to za využití rozhodovací praxe soudů. Zároveň by práce mohla sloužit jako ucelenější zdroj informací pro zletilé dítě, které se rozhodne řešit otázku výživného vůči svému rodiči soudní cestou.This diploma thesis focuses on the issue of adult child maintenance. It is systematically divided into two parts. The first part discusses the parents' obligation to provide maintenance for children from the aspect of substantive law. Furthermore, it defines the concept of maintenance and its subjects. Next, this part also analyses general criteria that have an impact on the amount of maintenance and that affect the adult child entitled to maintenance and the parents liable to pay it. It also deals with a negative prerequisite for granting maintenance, which determines whether the behaviour of the entitled child is in compliance with good morals. The last chapter of the first part concentrates on duration and termination of maintenance obligations and it focuses in detail on duration of maintenance related to education and health of an adult child. The second part discuses the issue from the aspect of procedural law; that is, the legal proceedings concerning the maintenance of an adult child. It describes the proceedings from the moment a lawsuit is filled over the course of the first instance proceedings to the moment when the judgment is provided (including the reimbursement of costs in court proceedings). The aim of this thesis is to analyse specifics of maintenance obligation of parents towards a child who has reached legal age. In my opinion, not enough attention is given to this issue as it is in the case of maintenance obligations of parents towards a minor. Moreover, the goal of the thesis is also to point out problematic situations that may arise in relation to the duration and termination of maintenance obligations using the decision-making processes of courts. The thesis could also serve as a comprehensive source of information for an adult child who decides to address the issue of parents' maintenance obligation through legal channels.
