(154 264 znaků). -- Oponent Filip Melzer. -- Ved. práce Petr Tégl. -- Abstrakt: Diplomová práce se zabývá institutem nezbytné cesty vymezeným v § 1029 a násl. OZ. Jedná se o situaci, kdy vlastník řeší přístup ke své nemovité věci přes cizí pozemek. Tento staronový institut řeší výjimečné situace, při kterých dochází k omezování vlastnického práva. V práci jsou proto převážně řešeny důvody, pro které nelze nezbytnou cestu povolit, ale také okolnosti s touto problematikou přímo související. Práce využívá historický vývoj právní úpravy s cílem posoudit funkčnost a vhodnost stávající úpravy nezbytné cesty. Zabývám se také srovnáním s rakouskou právní úpravou. V neposlední řadě se v práci snažím o vlastní postřehy a návrhy.. -- Abstrakt: My diploma thesis deals with the issue of the institute of the necessary path that is defined in § 1029 et seq. OZ. It is a situation in which the owner solves access to his real estate through someone else's land. This re-established legal institute solves exceptional situations in which are restricted the ownership rights. Therefore, the thesis mainly deals with the reasons for which it is not possible to allow the necessary path, but also the circumstances directly related to this issue. The thesis uses the historical development of the legislation in order to assess the functionality and suitability of the current legislation of the necessary path. I also deal with the comparison with the Austrian legislation. Last but not least, I try to make my own observations and suggestions.
