Oprávněné použití zbraně [rukopis] / Jan Střelec. -- 2017. -- 65 s. + 1 CD ROM. -- Oponent Petra Masopust šachová. -- Ved. práce Miroslava Vráblová. -- Abstrakt: Tato diplomová práce se zabývá oprávněným použitím zbraně, jako jednou z okolností vylučující protiprávnost upravenou v českém trestním zákoníku. Oprávněné použití zbraně dovoluje jednotlivým ozbrojeným složkám použít zbraň za splnění určitých podmínek. Cílem této diplomové práce je poskytnout ucelený pohled na institut oprávněného použití zbraně včetně detailního přehledu podmínek, za kterých může být zbraň použita podle jednotlivých právních předpisů, na které zákon odkazuje. Práce dále obsahuje komparaci právní úpravy České republiky s právní úpravou Slovenské republiky a návrhy de lege ferenda. První kapitola je věnována teoretické částí, najdeme zde definici trestného činu, činu jinak trestného a jejich důsledky, zánik trestnosti a okolnosti vylučující protiprávnost. Ve druhé kapitole je rozebíráno oprávněného použití zbraně od historického vývoje až po současnost, včetně vztahu oprávněného použití zbraně a nutné obrany. Třetí kapitola se zabývá vymezením pojmu zbraň. Čtvrtá, stěžejní kapitola komparuje použití zbraně dle jednotlivých právních předpisů. V kapitole páté najdeme srovnání české právní úpravy se slovenskou právní úpravou. Poslední, tedy kapitola šestá obsahuje návrhy právní úpravy de lege ferenda.. -- Abstrakt: This diploma thesis deals with the This diploma thesis deals with the justified use of the weapon as one of the circumstances excluding the illegality stipulated in the Czech Criminal Code. Authorized use of a weapon allows individual armed forces to use a weapon under certain conditions. The aim of this diploma thesis is to provide a comprehensive view of the institute of authorized use of a weapon including a detailed overview of the conditions under which the weapon may be used according to the individual laws to which the law refers. The thesis also contains a comparison of the legal regulations of the Czech Republic with the legal regulations of the Slovak Republic and the proposals de lege ferenda. The first chapter is devoted to the theoretical part, here we can find the definition of crime, an act otherwise criminal and their consequences, termination of crime and the circumstances that exclude unlawfulness. The second chapter discusses the legitimate use of a weapon from historical development to the present, including the relationship between the legitimate use of the weapon and the necessary defence. The third chapter deals with the definition of a weapon. The fourth, crucial chapter compares the use of weapons according to individual legal regulations. In chapter five we find a comparison of the Czech legislation with the Slovak legal regulation. The last, i.e. Chapter Six, contains proposals for the de lege ferenda legislation.
