Tato diplomové práce se zabývá možnostmi právní ochrany životního prostředí a lidských práv v oblasti horního práva, tedy v souvislosti s hornickou činností. Zaměřuje se na analýzu, rozbor a pohled de lege ferenda v oblasti střetu horního práva a základních lidských práv, která jsou hornickou činností dotčena, zejména na právo vlastnické, právo na příznivé životní prostředí a s tím související právo na zdraví. Dále se také zabývá střetem dvou veřejných zájmů a to zájmu na ochraně životního prostředí jako celku a zájmu na těžbě. Cílem celé práce je rozebrat a zhodnotit právní úpravu v této oblasti a hlavně poukázat na její nedostatky.This graduation theses is concerned with legal possibilities of environmental protection and protection of fundamental human rights in mining law, therefore in context with mining activities. This theses is related to analysis, study and reflection de lege ferenda in area of conflicts of mining law and fundamental human rights, which are by mining activities affected. These are primarily proprietary right, right of favourable environment and in context with this right also right for health. Also this theses is concerned with conflict of two public interests, these are interest of environmental protection and interest of exploitation. The aim of this graduation theses is analyse and review legal regulation in this area and in substance refer to its imperfections.
