(104 000 znaků). -- Oponent Jiří Jelínek. -- Ved. práce Bronislava Coufalová. -- Abstrakt: Diplomová práce se zabývá spolupracujícím obviněným, jakožto prostředkem boje proti organizovanému zločinu. Nejprve vymezuje pojem organizovaného zločinu, jeho nebezpečnost a potřebu efektivního potírání. Druhá kapitola představuje právní zakotvení spolupracujícího obviněného do českého právního řádu a zhodnocení souladu s mezinárodní koncepcí boje proti organizovanému zločinu. Vedle aktuální právní úpravy je v práci představen první návrh na zakotvení a následně provedena komparace obou konceptů. V kapitole třetí je provedena analýza hlavních problémů, které s sebou zakotvení institutu spolupracujícího obviněného do českého právního řádu přináší. Jedná se o kolizi se zásadami trestního řízení a další otázky, které jsou diskutovány odbornou veřejností. V kapitole čtvrté jsou rozebrány možnosti a limity ochrany osoby, která se rozhodne spolupracovat a tím vystaví sebe i své blízké nebezpečí odvety ze strany organizovaného zločinu. Poslední kapitola je věnována komparaci spolupracujícího obviněného s institutem informátora. Jedná se o odlišné prostředky boje proti organizovanému zločinu, ale objevují se zde i podobnosti.. -- Abstrakt: The diploma thesis deals with the cooperating accused as a subject of a fight against organized crime. Firstly, it defines the concept of organized crime, the danger and the requirement of effective combat. The second chapter presents the legal regulation of cooperating accused into Czech legislation and evaluate compliance with the international concept of the fight against organized crime. Besides the current legislation, the thesis introduces the first draft of incorporation of this institute into the Czech legislation and then there is performed a comparison of these two concepts. In the third chapter there is an analysis of the main problems, which come with the regulation of cooperating accused in the Czech legislation. These are the conflicts with the principles of criminal procedure and other issues that are discussed by experts. In the fourth chapter are analyzed the possibilities and limits of the protection of the person who decides to cooperate against the organized crime, and thereby they put themselves and their loved ones into danger of vengeance from organized crime. The last chapter is devoted to a comparison between the cooperating accused and institute of an informer. These two institutes are different ways of fighting against organized crime, however some similarities are evident.
