Tato diplomová práce komplexně zpracovává analýzu § 927 OZ upravujícího problematiku práva na styk mezi nezletilým dítětem a osobami odlišnými od jeho právních rodičů. Věnuje se zejména zákonným předpokladům nutným k přiznání práva na styk, jakož i specifickému postavení jednotlivých osob, jež o kontakt s nezletilým mohou žádat. Blíže je rozebíráno postavení osob příbuzných, ať už blízce nebo vzdáleně, a osob společensky blízkých. Z důvodu nutnosti objasnit práva putativního neboli domnělého otce je značná část práce věnována také roli biologických vazeb v rodinném právu. Uvedená problematika je analyzována zejména ve světle rozhodovací činnosti soudů, a to jak na národní, tak mezinárodní úrovni, kde jsou pro oblast ochrany soukromého a rodinného života velmi významná rozhodnutí Evropského soudu pro lidská práva.This diploma thesis comprehensively analyses Section 927 of the Czech Civil Code that regulates the issue of the right to contact between a minor child and people other than his legal parents. It especially deals with prerequisites that must be met according to the legislation as well as it deals with the specific circumstances of individual persons who may apply for contact with the minor. Therefore, it focuses on the rights of relatives, whether close or distant, and socially close persons. Due to the need of clarification of the status of a putative or supposed father, a large part of the thesis is devoted to the role of biological ties in family law. This overall area of law is analysed mainly in the light of the courts' decision-making activities, both at national and international level, where there are very important decisions of the European Court of Human Rights regarding the right to respect for private and family live.
