Práce se zabývá právní regulací způsobilosti k výkonu zdravotnických povolání, a to zejména z hlediska historického vývoje a souvislostí. Vymezuje základní instituty právní regulace zdravotnických povolání a charakterizuje je též ve vtahu k lidskoprávním souvislostem, včetně vztahu k evropskému právu. Práce podrobně charakterizuje též zdravotní správu a samosprávu z hlediska jejich vývoje, současnosti i ústavního zakotvení, poskytuje tak rámcový přehled o právním rámci systému zdravotní péče na našem území od nejstarších dob do současnosti. Vzhledem k právně historickému charakteru je pozornost věnována rovněž vývoji pramenů práva, jejich publikaci a závaznosti, včetně charakteru současných stavovských předpisů a metodických pokynů ústředních orgánů státní správy. Charakterizován je též vývoj lékařských fakult a škol, a to jak z hlediska jejich regulatorní funkce, tak i způsobu a míry jejich regulace státem. U zdravotnických povolání obecně, i u jednotlivých konkrétně jsou identifikovány právní předpisy upravující jejich právní regulaci. Pozornost je věnována kromě odborné způsobilosti též zdravotní způsobilosti a bezúhonnosti, a historickým institutům, které by dnes byly hodnoceny jako nepřípustná diskriminace či pracovní povinnost.The thesis deals with the legal regulation of qualification to perform medical professions, especially in terms of historical development and contexts. It defines basic institutions of legal regulation of health professions and also characterizes the relationship between them in the context of human rights, including in relation to European law. The theses also characterizes in detail the health administration and local governments in terms of their development, present and constitutional establishment, providing a general overview of the legal framework of the health care system in our country from ancient times to the present. Due to the historic nature of law, attention is also paid to the development of sources of law, their publication and bindingness, including the nature of current professional regulations and guidance from central government authorities. It is also characterized by the development of medical faculties and schools, both in terms of their regulatory functions, and the manner and extent of their regulation by the state. There are identified legal rules regulating medical professions in general, and also specific legislation. Attention is paid to conditions for the obtaining of qualifications for pursuing medical professions, including professional qualifications, good health, and blameless and historical institutes which would now be rated as unacceptable discrimination or forced labour.
