Zatěžující transpozice neboli gold-plating [rukopis] / Lucie Galvasová. -- 2021. -- 39 s. -- Ved. práce Ondrej Hamuľák. -- Oponent Zuzana Vikarská. -- Abstrakt: Bakalářská práce se zabývá neodůvodnitelnou zatěžující transpozicí směrnic Evropské unie, zvanou gold-plating, a jejími výskyty v České republice. Práce je postavena na správném vymezení pojmu transpozice a všech jejich neodmyslitelných náležitostí, neboť právě v jejím průběhu k regulatornímu zatížení dochází. Detailní průběh transpozice je popsán v rámci českého právního prostředí. Dále se práce zaměřuje na definici gold-platingu a charakterizaci jeho podob, důvodů jeho výskytu v členských státech Evropské unie a poukázáno je také na pozitivní dopady tohoto převážně negativního jevu. Důležitou součástí je náhled na preventivní opatření jednotlivých stran transpozice, tedy Evropské unie a České republiky, na kterou je tato práce zaměřena. Efektivita opatření působící proti gold-platingu je v práci zanalyzována prostřednictvím srovnání strategií České republiky a dalšího státu. Na závěr, práce poskytuje rozbor dvou konkrétních příkladů neminimalistické transpozice v České republice.. -- Abstrakt: This bachelor thesis deals with the non-justifiable onerous transposition of the European Union´s directives, called gold-plating, and it´s presence in the Czech Republic. This thesis is based on the correct definition of the term transposition and all of it´s essential requirements because, in the course of the transposition, the regulatory burden occurs. The course of the transposition process of the Czech Republic is also described in detail. Thereafter, the thesis is focused on the definition of gold-plating and on the characterization of it´s forms, reasons of the occurrence in EU member states and it is also pointed to the positive impact of this mostly negative phenomenon. The important part of the thesis is a closer look at the preventive measures of the particular parts of the transposition, which means the European Union and the Czech Republic, on which the thesis is focused. The efficacy of these measures is analysed by the comparison of the strategies of the Czech Republic and another state. Lastly, the thesis proffers an analysis of two specific examples of the non-minimalistic transposition in the Czech Republic.
