Tato diplomová práce se věnuje problematice důstojnosti a vážnosti advokátního stavu, jež je zakotvena v čl. 4 Etického kodexu advokáta. V úvodní části práce jsou v obecné rovině vymezeny důvody existence etických pravidel včetně argumentů pro jejich existenci a argumentů proti jejich existenci. V další části práce je nejdříve vymezen pojem výkon advokacie, na který práce navazuje obsahovou analýzou judikatury a kárných rozhodnutí. Cílem tohoto postupu je zjištění rozsahu působnosti čl. 4 Etického kodexu advokáta, zejména jeho přesahu do soukromého života. Za použití stejné metody jsou poté rozlišeny jednotlivé typy jednání advokáta a současně je stanoveno, na která z nich čl. 4 Etického kodexu advokáta dopadá a na která ne.This diploma theses deals with the issue of the dignity and seriousness of the legal profession which is enshrined in the Article No. 4 of the Lawyer's Code of Conduct. In the introductory part of this theses are generally defined the reasons of the existence of ethic rules inluding the arguments for the existence and the arguments against the existence. In the next part of this theses is firstly defined the term practice of advocacy to which the theses follows using the content analysis of the judicature and disciplinary judicature. The aim of this procedure is to determine the scope of the Article No. 4 of the Lawyer's Code of Conduct, in particular its transcendence into private life. Using the same method, the different types of lawyer's conduct are then distinguished and at the same time is determined which of them are affected by Article No. 4 of Lawyer's Code of Conduct and which are not.
