Nepominutelným dědicům je i proti vůli zůstavitele garantováno právo na povinný díl, který představuje určitý podíl na pozůstalosti nebo hodnotu takového podílu. Zvláštní ochranu nepominutelných dědiců může zůstavitel vyloučit vyděděním pouze ze zákonem stanovených důvodů, kterým nepominutelným dědicům odejme jejich právo na povinný díl i na dědický podíl. Problematika vydědění s sebou přináší množství výkladových potíží hmotného i procesního práva. Výkladové potíže souvisí především s vyvažováním principů familiarizace a autonomie vůle zůstavitele a dále s návazností hmotněprávní úpravy na procesní úpravu ochrany práv nepominutelných dědiců.. -- Abstrakt: Inheritance law provides special protection for the inheritable heirs, which are the children and other descendants of the testator. Against the will of the testator, the indispensable heirs are guaranteed the right to a compulsory share, which represents a certain share in the estate or the value of such a share. The testator may exclude special protection of unforgettable heirs by inheritance only for reasons stipulated by law, by which he shall deprive the unjustified heirs of their right to a compulsory share and to a share of the inheritance. The issue of inheritance brings with it a number of interpretive difficulties of substantive and procedural law. The difficulties of interpretation are mainly related to balancing the principles of familiarization and autonomy of the testator's will, as well as to the connection of the substantive legal regulation to the procedural regulation of the protection of the rights of the indispensable heirs.
