Ve své práci se věnuji testamentární volnosti zůstavitele ve vztahu k závěti. Nastiňuji konkrétní projevy zůstavitelovy volnosti a jeho oprávnění podle NOZ. Také tuto zůstavitelovu volnost srovnávám i s volností zůstavitele podle starších právních úprav. Zaměřuji se na oprávnění zůstavitele pouze ve vztahu k závěti jako jednoho z nejpoužívanějších dědických titulů v rámci testamentární dědické posloupnosti. Rozebírám možnost zůstavitele zahrnout do obsahu své závěti téměř jakékoliv přání a ovlivnit tak osud jeho majetku podle jeho vůle. Poté se zabývám formami závěti, ze kterých má zůstavitel na výběr, a popisuji různé způsoby zrušení závěti. V rámci celé práce také poukazuji na různé požadavky a omezení, které současná právní úprava zůstaviteli ukládá, čímž dochází k omezování jeho testamentární volnosti. Na závěr se zabývám problematikou zůstavitelovy volnosti ve vztahu k závěti podle polské právní úpravy.In my thesis I deal with testamentary freedom of the testator in relation to the testament. I describe specific manifestations of testamentary freedom and authorization of the testator accoriding to new Civil Code. I compare present testamentary freedom with his freedom by earlier legislation. I focus on the authority of the testator in relation to the testament as one of the most popular titles in succession within testamentary succession. I explain the possibility of the testator to include in the contents of the testament almost any desire to influence the fate of his property according to his will. Then I deal with the forms of the testament, of which the testator can choose and I describes various methods of revocation of the testament. As part of the thesis I demonstrate different requirements and limitations that current legislation requires the testator, thereby limiting the testamentary freedom. In conclusion, I deal with the issue of testamentary freedom of the testator in relation to the testament according to the Polish law.
