Práca sa zaoberá možnosťou posunu politického systému Českej republiky smerom k poloprezidentskému typu režimu, a to v rámci súčasného nastavenia ústavných pravidiel. Hlavný dôraz je kladený na analýzu ústavného textu s cieľom zistiť či poskytuje potenciál k jej alternatívnemu výkladu, ktorý by posilnil pozíciu českého prezidenta. Najskôr sú postupne predstavené vybrané relevantné teoretické koncepty, ktoré pojednávajú o poloprezidencialisme, ktorých autormi sú Giovanni Sartori, Maurice Duverger, Matthew S. Shugart a John M., Carey, respektíve ich upravená verzia kvantifikovaného prístupu k hodnoteniu sily prezidentských právomocí autorkou Lee K. Metcalf. Tieto koncepty sú následne aplikované na prípad Českej republiky, za účelom zistiť, nakoľko spĺňa atribúty poloprezidentského režimu, prezentované ako relevantné jednotlivými definíciami. Tretia časť obsahuje analýzu kompetencií prezidenta republiky vyplývajúcich z Ústavy, konkrétne článkov č. 62 a 63, tzn. najskôr právomocí výlučných a následne tých, ktoré podliehajú kontrasignácii. Práca sa podrobnejšie zameriava na tie články Ústavy Českej republiky, ktorých voľná formulácia predstavuje potenciál rozpútať interpretačný spor v súvislosti s praktickým výkonom danej právomoci. Na základe analýzy kontinuálneho vývoja českého politického systému vo vzťahu k jednotlivým prezidentským právomociam a odhalenie priestoru pre extenzívnu interpretáciu v rámci relatívne vágneho textu ústavy Českej republiky autorka dochádza k záverom, že Českú republiku možno považovať za systém s veľkým potenciálom posunu smerom k poloprezidencialismu. Dokonca je možné konštatovať, podobne ako naznačujú aj zahraničné autori, že základné charakteristické rysy poloprezidencialismu sú už naplnenéThe work deals with the possibility of shifting the political system of the Czech Republic towards the semi-presidentialism type of regime, in the current set of constitutional rules. The main focus is on the analysis of the constitutional text to see whether it provides some potential for an alternative interpretation, which would strengthen the position of the Czech President. Firstly, selected relevant theoretical concepts are gradually introduced, which deal with semi-presidencialism whose authors are Giovanni Sartori, Maurice Duverger, Matthew S. Shugart and John M. Carey, or their modified version of a quantified approach to assessing strength of presidential powers author K. Lee Metcalf. These concepts are then applied to the case of the Czech Republic, in order to find out which attributes of semi-presidential regime, relevant for individual definitions, are present. The third section contains an analysis of the President's powers under the Constitution, namely Articles no. 62 and 63, it means exclusive powers and then those with necessary countersignature. The work focuses more in detail on those articles of the Constitution of the Czech Republic, where their free formulation hides a potential to unleash interpretation disputes in connection with the practical exercise of the powers. Based on the analysis of ongoing development of the Czech political system in relation to individual presidential powers and reveal space for extensive interpretation within a relatively vague text of the Constitution of the Czech Republic, the author concludes that the Czech Republic can be regarded as a system with great potential shift towards semi-presidencialism. Even it can be stated, as well as foreign authors suggest, that the basic characteristics of semi-presidencialism are already fulfilled.
