Hlavním předmětem diplomové práce je zkoumání odpovědi na otázku, zda je přítomnost otce u porodu základní lidské právo, či ne. Práce si klade za cíl zjistit, zda je v České republice právo otce být přítomen u porodu garantováno a v lékařské praxi ve zdravotnických zařízeních dodržováno. Diplomová práce obsahuje úvod, tři kapitoly a závěr. Práce se zaobírá základními právními i lékařskými definicemi, které se vztahují k tématu. Rovněž řeší i historické a zdravotnické aspekty práva otce být přítomen u porodu. V práci je vymezen právní rámec přítomnosti otce u porodu, a to včetně jeho subsumpce pod základní právo na rodinný život dle judikatury Evropského soudu pro lidská práva a Ústavního soudu. Závěrečná část práce se zaměřuje na omezování práva otce být přítomen u porodu, včetně aplikace testu proporcionality. Poměřováno je právo na ochranu rodinného života otce s právem na ochranu zdraví veřejnosti.The main topic of the diploma thesis is the investigation of the answer to the question whether the presence of the father at the birth of their child is a basic human right or not. The thesis aims to find out whether the right of the father to be present at the birth of their child is guaranteed in the Czech Republic and respected in medical practice in medical facilities. The diploma thesis contains an introduction, three chapters and a conclusion. The work deals with basic legal and medical definitions related to the topic. It also deals with the historical and medical aspects of the father's right to be present at the birth of their child. The thesis defines the legal framework of the father's presence at childbirth, including his subsumption under the basic right to family life according to the jurisprudence of the European Court of Human Rights and the Constitutional Court. The final part of the work focuses on limitations the father's right to be present at the birth of their child, including the application of the proportionality test. The right to protect the father's family life is measured against the right to protect public health.
