Činnost notáře v dědickém řízení na praktických případech z olomoucké notářské praxe v letech 1946 - 1954" Diplomová práce se zabývá činností notáře v dědickém řízení a je zaměřena na období od roku 1946 do roku 1954. V této práci detailně rozebírám hlavně právní úpravu, která se vztahuje k činnosti notáře. Krátce se zde věnuji historickému vývoji. Zaměřuji se na notářské řády z roku 1871, 1949 a 1951, kde se snažím charakterizovat osobu notáře, jeho postavení, činnost a notářský úřad a změny, které nastaly. Dále se zabývám právní úpravou dědického práva a dědického řízení v těchto letech. Práce je rozdělena do osmi částí a stěžejní část tvoří praktické případy. Změny právních úprav zkoumám na praktických případech, které mi poskytl Okresní archiv v Olomouci. Zvolila jsem čtyři případy, detailně rozebírám celý obsah spisu a aplikuji na danou problematiku právní úpravu. Hlavním cílem této práce je rozbor archivního materiálu a zhodnocení odrazu aktuální právní úpravy hmotného práva občanského, civilního procesu a notářského řádu v činnosti olomouckých notářů v dědickém řízení.Notary´s activities in inheritance proceedings on practical cases of Olomouc notarial practice during the years 1946 - 1954" This thesis will focus on notarial activities of inheritance proceedings, targeting a period of working experience from 1946 to 1954. I will analyze the main legal rules in relation to the notarial activities. I will also shortly note the relevant history, detailing the notary orders in 1871, 1949 and 1951. I will describe a person of notaries, their status and main activities, notarial office and further historic changes that have occurred. I will also mention rules of the inheritance law and inheritance proceedings in the years. The all thesis is divided into eight separate parts when the vital part consists of practical cases provided to me by the District archives in Olomouc. I will examine these to depict changes of law rules. Further to my examination, I have chosen four individual cases, particularly analyzing the contents of the files and applying to the issue of legal regulation. The main objective of this thesis is an analysis of archival material and an assessment of the actual substantive rules of civil law, civil procedure law and rule of the notary in the activities of notaries in Olomouc inheritance proceedings.
