Práce se zaměřuje na téma výživné k nezletilým dětem, a to především na kritéria, která jsou užívána k určování výše výživného. Cílem práce bylo určit, zda jsou u nás kritéria dostačující, srozumitelná a v souladu s nejlepšími zájmy dítěte, či by mělo v této oblasti dojít k nějakým změnám. Práce je rozdělena do čtyř kapitol, úvodu a závěru. V úvodu je vysvětlena volba tématu, způsob zpracování práce a obecné informace k právní úpravě a jejímu vývoji. V první kapitole se zabývám institutem vyživovací povinnosti obecně. V kapitole druhé je již podrobněji rozebrána vyživovací povinnost k nezletilým dětem. Kapitolu třetí považuji za stěžejní, jelikož se zde věnuji samotným kritériím stanovování výživného, jako například kritériu dobrých mravů, možnosti, schopnosti a majetkových poměrů povinného. Ve čtvrté kapitole se může čtenář seznámit s placením výživného, s jeho splatností, institutem zálohy na výživné a změnou poměrů. Závěrem shrnuji získané poznatky a hodnotím, zda se při určování výše výživného děje vše v zájmu dítěte, a nemělo by dojít k určitým změnám v legislativě a praxi.The thesis deals with theme The maintainance to minor children especially with criteria that are used to determine the height of maintainance. Aim of the thesis is finding out if the criteria are adequate, understastandable and consistent with the best interest of a child or if there should be any changes. The thesis is divided into introduction, four chapters and conclusion. In the introduction there is explained the choice of the theme, the development of the thesis and general information about legislatition and its history. The first chapter deals with the maintainance generally. In the second chapter there is analyzed the maintainance to minor children. The third chapter is considered the most important because it deals with the criteria of determining the height of maintainance, for example the criteria of good manners, possibilities, opportunities and financial abilities of person obligated to pay the maintainance. In the forth chapter the reader is acquainted with the institution of paying the maintainance, the due date of maintainance. The other thing solved in this chapter is the prepayment of maintainance and the change of living conditions. Finally in the conclusion I summarize the cognitives the knowledge and I consider if the process of determining the maintainance is in the best interest of child, and if there should or should not be any changes in legislation and practice.
