Tato diplomová práce pojednává o jednostranné změně obchodních podmínek. Práce bude postupně řešit následující otázky: (1)jakou povahu má jednostranná změna a zda je změna dle § 1752 NOZ skutečně změnou jednostrannou, (2) jaké jsou limity změny obchodních podmínek, (3) stanovuje právní řád odlišné podmínku pro změnu obchodních podmínek v případě spotřebitelských smluv. Autor pracuje s českými a zahraničními zdroji. Autor bude využívat především německou a rakouskou judikaturu, které se problematikou změny obchodních podmínek zabývají desítky let.This thesis deals with the unilateral change of the general terms and conditions. The following problems will be solved: (1) the nature of unilateral change and whether the change under § 1752 NOZ is a unilateral change, (2) the limits of the change of the general terms and conditions, and (3) whether the law sets up different requirements for the change of the general terms and conditions in the case of contracts in general and consumer contracts in particular. The author uses Czech sources as well as foreign sources. The author works with German and Austrian case law in particular, because these nations have been developing the concept of the general terms and conditions over ten years.
