Tato diplomová práce si klade za cíl poskytnout širší pohled na problematiku černých staveb, jeden z fenoménů českého stavebního práva. Snaží se odpovědět na otázky, proč nevyužívají stavebníci zákonných postupů, jak může stavební úřad s černou stavbou naložit a jak sankcionovat osoby, které se na vzniku a užívání černé stavby podílejí. První kapitola je věnována výkladům nezbytných pojmů jako je stavba, nepovolená stavba a černá stavba. Kromě pojmů obsahuje kapitola i některé důvody vzniku černých staveb a úvahu o některých povolovacích procesech. Druhá kapitola se týká postupu úřadu, jak zastavit stavební práce, jak odstranit stavbu a kdo bude nést náklady na její odstranění. Obsahuje také možnosti nuceného výkonu rozhodnutí. Třetí kapitola naopak popisuje, jaké jsou možnosti pro zachování stavby. Kapitola se tedy věnuje dodatečnému povolení stavby a obdobným postupům. Poslední část práce je věnována správním deliktům. V práci jsou popsány jednotlivé problémy právní úpravy a její rezervy. Kde je to možné, obsahuje práce návrhy de lege ferenda.The aim of this diploma thesis is to provide a broader outlook on the issue of unauthorised constructions, one of the phenomenon of the Czech construction law. The thesis tries to provide answers to following questions. Why the builders don't use the legal procedures to obtain building permission? How can the construction office deal with the unauthorised constructions? How can the office sanction people who participate in the build and use of the unauthorised construction? The first chapter is devoted to the necessary description of the terms such as construction, unauthorised construction and "black construction". Besides that it contains some reasons for building without permission and it covers some permission processes. The second chapter contains the office's course of action to stopping the construction works, demolishing the building and the matter of paying costs for the demolition. It covers the options of compulsory execution of the decision as well. The third chapter describes the options to preserve the construction. It focuses on subsequent legalization of the building and similar procedures. The last part of the thesis is dedicated to the administrative offences. The issues of the legislation and its weak points are being described in this thesis. If it is possible it provides suggestions de lege ferenda.
