Cílem diplomové práce je poskytnout ucelené pojednání o cizineckém režimu v České republice. Vlastní analýze předchází vymezení základních pojmů, které bezprostředně souvisí s postavením cizinců a jež jsou základem pro další práci. Hlavní pozornost je věnována vnitrostátní právní úpravě, zejména postavení cizinců v ústavním pořádku České republiky s ohledem na Ústavu ČR a Listinu základních práv a svobod. Analýza je provedena s vazbou na zákonnou úpravu týkající se oblasti pobytů a pohybu cizinců v ČR a azylové problematiky. Další část práce poskytuje přehled mezinárodních závazků v podobě mezinárodních partikulárních smluv a obecně platných pravidel mezinárodního práva, jež musí stát při vytváření vnitrostátních pravidel respektovat. Nejprve je proveden rozbor závazků na mezinárodní úrovni v souvislosti s úmluvami OSN, poté je přiblížena oblast regionálních instrumentů ochrany lidských práv ve spojitosti s Radou Evropy a Evropskou unií. Závěrečná část práce se soustřeďuje na aplikaci cizineckého práva v praxi ve formě konzultace s poradnou pro cizince, cizineckou policií a příkladů z judikatury českých soudů nebo z činnosti veřejného ochránce práv.The aim of this thesis is to provide a comprehensive treatise on the foreign system in the Czech Republic. The definition of basic concepts which are directly linked to the status of foreigners and which are the basis for further work precedes the own analysis. The main attention is paid to national legislation, particularly the status of foreigners in the constitutional order of the Czech Republic with regard to the Constitution of the Czech Republic and the Charter of Fundamental Rights and Freedoms. The analysis is linked to the statutory framework relating to the movement and the residence of foreigners and asylum issues. The next part provides an overview of international obligations in form of international treaties and generally accepted rules of international law, which must be respected when creating national rules. First, the analysis of commitments in international conventions in relation to the UN is made, then the area of the regional human rights instruments in connection with the Council of Europe and the European Union is clarified. The final part focuses on the application of alien law in practice in the form of consultation with counseling centre for foreigners, foreign police and examples from the case of Czech courts or from the work of Ombudsman.
