Tato práce je zaměřena na vznik a koncepci lidských práv a svobod v pojetí právní teorie. Jejím smyslem je především bližší seznámení s vývojem základních lidských práv a svobod a jejich postavením v demokratickém právním státě. Vznik lidských práv je spojen se samotnými počátky existence lidských společností, první část práce je tedy věnována právě jejich genezi. V druhé části je rozebrán pojem a podstata základních práv a svobod. Problematika univerzality lidských práv je poté nastíněna v části třetí. Další úsek práce je věnován koncepci základních práv a svobod v České republice. Pojednává o Listině základních práv a svobod, charakteristice základních práv a svobod, jejich nositelích a adresátech, a dále o klasifikaci lidských práv. V této části je rovněž provedena analýza článku 6 Listiny základních práv a svobod. Jelikož je nedotknutelné a přirozené principy, kterými lidská práva jsou, bezesporu třeba chránit, je poslední část práce věnována právě jejich ochraně, a to jak na úrovni vnitrostátní, tak v rámci evropského systému ochrany lidských práv.This thesis focuses on the creation and conception of human rights in juristic Theory. The main point of this work relies on the development of human rights and freedoms and on the role of human rights and freedoms in a democratic state. The creation of human rights principles is linked to the beginning of human society that is why the first chapter of this thesis deals with the genesis of Fundamental rights and freedoms. The second chapter analyse the definition and body of Fundamental rights and freedoms. The third chapter of this thesis deals with universality of human rights and freedoms. The following chapter is focused on the conception of Fundamental rights and freedoms in the Czech Republic, it´s addressers and bearers, as well as, the classification of human rights. In this part, an analysis of the Bill of Fundamental rights and freedoms sitxth chapter is made. The last part of my work, is dedicated to the protection of the Fundamental rights and how do these rights work in a country as well as in the European system framework due to the natural and untouchable human right principles.
