Práca sa zaoberá kreáciou ústavných sudcov a s tým súvisiacimi otázkami, ako napríklad právnej úpravy kreácie, výberu kandidátov na funkciu ústavných sudcov, požiadaviek na osobu kandidáta, ako aj subjektmi, ktoré sú oprávnené predkladať návrhy týchto kandidátov, voľbou kandidátov alebo vyslovením súhlasu s menovaním týchto kandidátov a ich menovaním do funkcie. Predmetom práce je i počet ústavných sudcov a dĺžka funkčného obdobia, postavenie ústavných sudcov a inkompatibilita funkcie s inými činnosťami. Jednotlivé kapitoly sa venujú uvedeným inštitútom v súvislosti s ústavnými súdmi, ktoré pôsobili v Československej republike, Českej a Slovenskej Federatívnej republike a pôsobia v súčasnosti v Slovenskej republike a Českej republike. Teoretické informácie dopĺňajú tiež praktické skúsenosti s aplikáciou právnych úprav. Práca ďalej porovnáva právne úpravy, poukazuje na ich sporné aspekty, klady a zápory a navrhuje prípadné zmeny českej právnej úpravy de lege ferenda.The work deals with creation of judges of the Constitutional courts and other connected questions such as the legal adjustment of the creation, selection of the candidates, requirements for the candidates, the subjects who propose the candidates, the election of the judges or the agreement with naming candidates to the function. The work contains as well legal adjustment of the number of judges and the length of their term office, the position of the judges and incompatibility with other activities. The chapters of the work deal with these legal institutions in connection with the Constitutional Courts that operated in the Czechoslovak Republic and the Czech and Slovak Federal Republic, and have been operating nowadays in the Slovak Republic and the Czech Republic. The theoretical information is completed with the experience of application of the legal adjustment. The work compares these four adjustments, shows the questionable aspects, pros and cons and proposes possible alternation of the Czech legal adjustment.
