Diplomová práce se zabývá v současné době aktuálními alternativami k nepodmíněnému trestu odnětí svobody. V samostatných kapitolách upravuje podmíněné odsouzení k trestu odnětí svobody, obecně prospěšné práce, peněžitý trest a také nové tresty domácí vězení a zákaz vstupu na sportovní, kulturní a jiné společenské akce. V rámci těchto trestů je nastíněna jejich současná hmotněprávní i procesněprávní úprava, zároveň i porovnání s předchozí úpravou. Práce podává ucelený pohled na využití nejdůležitějších hmotněprávních alternativních trestů k nepodmíněnému trestu odnětí svobody se zaměřením na obecně prospěšné práce a peněžitý trest, uvedení charakteristických rysů těchto trestů, problémy související s jejich uplatněním a výkonem a jejich případné řešení.The thesis deals with the up-to-date issue of alternatives to unconditional sentence of imprisonment. The individual chapters analyze suspended sentence, community service order, financial punishment, and also new kinds of punishments: house arrest and prohibition of entry to sports, cultural and other social events. Within these punishments, their current substantive and procedural rules are outlined, and the new legal regulation is compared with the previous Criminal Code. The thesis offers a summary of the usage of the most important substantive alternative punishments with a special focus on community service order and financial punishment. It specifies the characteristic attributes of the punishments, some problematic aspects of their imposition and execution, and their possible solution
