Tato bakalářská práce se zabývá stavem legislativní nouze. Popisuje stav legislativní nouze a analyzuje aplikaci legislativní nouze v praxi, přičemž se soustředí na aplikaci stavu legislativní nouze za koronavirové krize. Cílem práce je zhodnotit, zda dochází k zneužívání stavu legislativní nouze. Začátek práce se věnuje zákonodárnému procesu ve stavu legislativní nouze. Práce popisuje zákonné a ústavní podmínky vyhlášení a trvání stavu legislativní nouze. Dále se práce věnuje používání stavu legislativní nouze v České republice. Vyhodnocuje aplikaci legislativní nouze a její zneužívání. Zvláštní kapitola se věnuje použití stavu legislativní nouze v době pandemie covidu-19.This bachelor thesis deals with the state of legislative emergency. It describes the state of legislative emergency and analyzes the application of the state of legislative emergency in practice, focusing on the application of legislative emergency during coronavirus crisis. The aim of the thesis is to assess whether the state of legislative emergency is being abused. The beginning of the work is devoted to the legislative process in a state of legislative emergency. The thesis describes the legal and constitutional conditions for the declaration and duration of a state of legislative emergency. The thesis then examines the use of the state of legislative emergency in the Czech Republic. It evaluates the application of legislative emergency and its abuse. A special chapter is devoted to the use of the state of legislative emergency during the covid-19 pandemic.
