Zkoumání odmítání krevních transfuzí ze strany nezletilých pacientů a jejich rodičů je hlavním předmětem této diplomové práce. Za cíl si pak klade zjistit, zda ochrana života nezletilého pacienta skutečně převažuje nad zásahem do svobody náboženského vyznání a víry těchto pacientů, případně jejich rodičů. Zejména se práce věnuje otázce nezletilých pacientů z řad svědků Jehovových a jejich možnosti adekvátně rozhodovat o odmítání život zachraňující krevních transfuzí. Práce je zaměřena na komparaci zásahu do náboženského vyznání i autonomie nezletilého pacienta na jedné straně a ochraně jeho života na straně druhé. Účelem práce je zjištění, zda by mělo být nezletilým pacientům umožněno odmítnout krevní transfuzi, případně jinou život zachraňující péči, byť by toto rozhodnutí vedlo k jejich smrti. A pokud ano, jaké podmínky by měly být zavedeny. Diplomová práce obsahuje úvod a závěr, dále je rozdělena do šesti kapitol. V prvních dvou kapitolách je věnován prostor definování pojmů a vymezení příslušné právní úpravy. Následně jsou zde rozebrány možnosti odmítání krevních transfuzí. Důraz je kladen na náboženské důvody, především ze strany svědků Jehovových. Závěrečná část práce porovnává ochranu života nezletilých s náboženskou svobodou pacientů i jejich rodičů. Nakonec je navrženo možné východisko při řešení zkoumaných případů.The investigation of the refusal of blood transfusions by minor patients and their parents is the main subject of this thesis. It then aims to find out whether the protection of the life of a minor patient really outweighs the interference with the freedom of religious belief and belief of these patients, or their parents. In particular, the work is devoted to the issue of minor patients from among Jehovah's Witnesses and their ability to make adequate decisions about refusing life-saving blood transfusions. The work is focused on the comparison of interference with the religious belief and autonomy of a minor patient on the one hand and the protection of his life on the other. The purpose of the work is to determine whether minor patients should be allowed to refuse a blood transfusion or other life-saving care, even if this decision would lead to their death. And if so, what conditions should be put in place. The diploma thesis contains an introduction and a conclusion, and is further divided into six chapters. In the first two chapters, space is devoted to the definition of concepts and the definition of the relevant legislation. Subsequently, the options for refusing blood transfusions are discussed here. The emphasis is on religious reasons, especially on the part of Jehovah's Witnesses. The final part of the work compares the protection of the lives of minors with the religious freedom of patients and their parents. Finally, a possible solution to the investigated cases is suggested.
