Tato diplomová práce pojednává o problematice restorativních programů a jejich využití v českém trestním právu. V prvé řadě se zabývá samotnými pojmy restorativní justice a restorativní programy. Dále navazuje na současné projevy restorativní justice v České republice. Následně diplomová práce popisuje základní typy restorativních programů, jejich průběh a samotné cíle. Pomocí komparativní metody práce mapuje právní úpravy v zahraničí, ve kterém se již uplatňují restorativní programy. Významným činitelem je také evropská právní úprava, která počítá se zavedením restorativních programů a vymezuje kvalitativní požadavky na jejich náležitosti. Práce se dále zaměřuje na současný stav restorativních programů v České republice a odkazuje na potřebu vést statické údaje za účelem rozvoje samotných institutů. S ohledem na absenci právní úpravy restorativních programů v České republice je stěžejním obsahem práce právní úprava de lege ferenda, která nastiňuje řešení základních právních otázek v souvislosti s ukotvením restorativních programů do právního řádu.This thesis focuses on issues of restorative programs and their use in matters of Criminal Law of the Czech Republic. In the first part, the thesis explains definitions and concepts and provides general introduction to restorative justice and restorative programs. Later, it presents current trends and manifestations of restorative justice in the Czech Republic. The thesis also describes basic types of restorative programs, their planned courses, and goals they aim to achieve. Using comparative methods, this thesis reviews legal regulations of foreign countries in which restorative programs are already implemented. An important factor is the European legislation, which both predicts and supports further rise of restorative programs and defines their qualitative requirements. The thesis then focuses on the current state of restorative programs in the Czech Republic and points out the need to collect and keep statistic data to further develop institutes of restorative justice. Considering the absence of legal regulations for restorative programs in the Czech Republic, the main content of this thesis is to outline the legal regulations de lege ferenda, which would provide possible solutions and answers to basic legal questions concerning the anchoring of restorative programs in the Law.
