Diplomová práce se zaměřuje na instituty, které nabourávají aktuální koncepci pojetí mateřství v § 775 zákona č. 89/2012 Sb., občanského zákoníku. Práce se zabývá porody s utajenou totožností matky, diskrétními porody, anonymními porody a problematikou babyboxů. Pojednává o jejich historii, důvodech vzniku, právní úpravě a zejména o úskalích, která se s instituty pojí. S ohledem na poukázání jejich (ne)funkčnosti, práce popisuje právní úpravu těchto institutů v jiných státech. Celou prací se prolíná právo dítěte znát svůj původ, které stojí proti osobnostnímu právu matky zůstat utajena.The thesis focuses on the institutes that undermine the current concept of maternity in § 775 of the act no. 89/2012, Civil Code. The thesis deals with birth with the concealed identity of the mother, discreet birth, anonymous births and the issue of babyboxes. It discusses their history, the reasons for their creation, the legal regulation and especially the pitfalls associated with the institutes. With regard to pointing out their (in)functionality, the thesis describes the legal regulation of these institutes in other countries. The right of the child to know his or her origins is interwoven throughout the thesis, which is juxtaposed with the mother's personal right to remain hidden.
