Tématem diplomové práce je společné oddlužení manželů. Práce je rozdělena do čtyř částí. První tři kapitoly jsou odděleny důležitými mezníky v oddlužení. Práce je vymezena od podání insolvenčního návrhu a návrhu na povolení oddlužení do zjištění úpadku spolu s povolením oddlužení, dále od zjištění úpadku a povolení oddlužení do schválení, příp. neschválení oddlužení, a nakonec od schválení oddlužení do ukončení řízení. Poslední kapitola se věnuje atypickým situacím v oddlužení - smrt a rozvod mezi manželi. První část obsahuje jak problematiku návrhu na povolení oddlužení manželů, tak společný úpadek manželů, a společné povolení oddlužení. Další část rozvádí okruh otázek týkající se přezkumného jednání manželů, popírání pohledávek manželi, přihlašování pohledávek za manželi, a také schválení, příp. neschválení společného oddlužení. Třetí část je věnována době, od které bylo vydání usnesení o schválení oddlužení a určena jedna ze zákonných forem oddlužení. Zde se zaměřuji na práva a povinnosti dlužníků po schválení oddlužení, vlivu oddlužení na vypořádání SJM spolu se zaměřením na ukončení řízení manželů, a to zrušením, či splněním. Poslední část se tedy věnuje situacím, kdy se manželé v průběhu řízení rozvedou, či jeden z nich zemře.The topic of the thesis is joint debt relief of spouses. The thesis is divided into four parts. The first three chapters are separated by important milestones in the debt relief. The thesis is defined from the filing of insolvency petition and the petition for authorisation of debt relief to the finding of bankruptcy together with the authorisation of the debt relief, next from finding of the bankruptcy and the authorisation of the debt relief to the approval or eventually disapproval of the debt relief, and finally from the approval of the debt relief to the end of the insolvency proceedings. The last chapter deals with unusual situations in the debt relief - death and divorce of the spouses. The first part contains both - issues of the application for authorisation of the spouse's debt relief, the joint debt relief of spouses, and the joint authorisation of the debt relief. The next part elaborates on the range of issues related to matrimonial review actions, denial of claims of the spouses, filing claims of the spouses, and the approval or disapproval of the joint debt relief. The third part deals with period, from which the order approving the debt relief was issued and one of the statutory forms of the debt relief was determined. Here I focus on the rights and obligations of the debtors after the approval of the debt relief, influence of the debt relief on settlement of community property, together with a focus on termination of matrimonial proceedings, either by cancellation or by fulfilment. The last part deals with situations when the spouses divorce or one of them dies during the proceedings.
