Tato diplomová práce se zabývá tématem a problematikou metody pachové identifikace jako důkazu v trestním řízení. Začátek práce se věnuje seznámení se s pojmem metody pachové identifikace, její historii, průběhu provádění a uvedení do širšího kontextu. Postupně je v práci více rozebírán pohled na metodu z hlediska podmínek její přípustnosti jako důkazu v trestním řízení. Je zde rozebrán i pohled českých soudů na metodu v průběhu let a k vypíchnutí zásadních věcí judikovaných soudy týkající se metody pachové identifikace. Pro lepší pochopení metody jsou v práci zmíněny i procesy a postupy, jak se metoda provádí v jiných státech a jak je brána z hlediska důkazu v trestním řízení. V konečné části práce jsou probrány problematické aspekty související s metodou a úvahy de lege ferenda, které jsou zároveň přínosem práce, neboť mimo jiné mapují možnosti, jestli může být metoda nějakým způsobem zlepšena či ne. Cílem práce je zjištění, zda je tato metoda stále vhodná, potřebná a přínosná pro české soudnictví a (policejní) praxi.This diploma thesis deals with the topic and issues of the method of scent identification as an evidence in criminal proceedings. The beginning of the thesis is devoted to the introduction of the concept of the method of scent identification, its history, the process of its implementation and introduction to the broader context. Gradually, the thesis discusses more about the method in terms of the conditions of its admissibility as evidence in criminal proceedings. It also discusses the Czech courts' view of the method over the years and highlights key cases decided by the courts concerning the method of scent identification. For a better understanding of the method, the paper also mentions the processes and procedures, how the method is implemented in other countries and how it is taken in terms of evidence in criminal proceedings. In the final part of the thesis, problematic aspects related to the method and de lege ferenda considerations are discussed, which are also a contribution of the thesis as they, among other things, map out the possibilities whether the method can be improved in some way or not. The aim of the thesis is thus to determine whether the method is still appropriate, necessary and beneficial for the Czech judiciary and (police) practice.
