Diplomová práce je zaměřena na trest domácího vězení a je rozdělena do šesti kapitol. Jedním z cílů této práce je podrobit právní úpravu trestu domácího vězení podrobné analýze a poskytnout tak nejen pouhý nekritický popis, ale upozornit i na problematické aspekty tohoto trestu a následně nabídnout návrhy de lege ferenda. Významná část práce pojednává o kontrole výkonu tohoto alternativního trestu. Cílem této části je porovnat způsoby kontroly a jejich efektivitu před a po zavedení elektronického monitoringu odsouzených. Posledním cílem je komparace české právní úpravy s úpravou zahraniční (Anglie a Wales, Německo) a snaha o nalezení inspirace pro český právní řád. První kapitola diplomové práce obsahuje vymezení základních pojmů. Následuje kapitola věnovaná historii trestu a po ní kapitola věnovaná rozboru současné právní úpravy. Čtvrtá kapitola pojednává o výkonu a kontrole výkonu trestu domácího vězení. Obsahem páté kapitoly je komparace se zahraniční právní úpravou a poslední kapitola se zaměřuje na výhody a nevýhody trestu domácího vězení a rovněž na návrhy de lege ferenda.The diploma thesis is focused on the sentence of house arrest and is divided into six chapters. One of the aims of this work is to subject the legal regulation of house arrest to a detailed analysis and thus provide not only a non-critical description, but also to draw attention to problematic aspects of this sentence and subsequently offer drafts de lege ferenda. A significant part of the work deals with the control of the execution of this alternative punishment. The aim of this part is to compare the methods of control and their effectiveness before and after the introduction of electronic monitoring of convicts. The last goal is to compare the Czech legislation with foreign legislation (England and Wales, Germany) and attempt to find inspiration for the Czech legal system. The first chapter of the diploma thesis contains the definition of basic concepts. This is followed by a chapter devoted to the history of punishment, followed by a chapter devoted to the analysis of current legislation. The fourth chapter deals with the execution and control of the execution of house arrest. The content of the fifth chapter is a comparison with foreign legislation and the last chapter focuses on the advantages and disadvantages of house arrest and also on drafts de lege ferenda.
