Tato diplomová práce pojednává o problematice ochrany zvířete v trestním právu, a to zejména v kontextu poslední novely trestního zákoníku. V práci jsou vymezeny důležité pojmy související s ochranou zvířat, které trestní zákoník nedefinuje, zejména pojem "zvíře" a pojem "týrání", a dále i další pojmy objevující se ve skutkových podstatách trestných činů na ochranu zvířat. Stěžejním obsahem práce je popis, rozbor a zhodnocení poslední novely trestního zákoníku, zákona č. 114/2020 Sb. V práci je poukázáno na nedostatky nové úpravy a jsou navržena některá možná řešení. V poslední části jsou porovnány výše sankcí stanovených za trestné činy na ochranu zvířat se sankcemi stanovenými za jiné trestnými činy dle zvláštní části trestního zákoníku, a také se sankcemi dle některých zahraničních úprav.This diploma thesis deals with the issue of the protection of animals in the criminal law, particularly in the context of the latest amendment to the criminal code, act no. 114/2020. The thesis defines important terms related to animal protection, which are not defined by the criminal code, specifically the term "animal" and the term "maltreatment of animal," as well as other terms appearing in the definitions of crimes against animal welfare. The main content of the thesis is a description, analysis and evaluation of the latest amendment to the criminal code. The thesis points out the shortcomings of the new regulation and suggests some possible solutions. The last part compares sanctions set for committing a crime against animal welfare with sanctions set for other crimes under the special part of the criminal code, as well as with sanctions according to some foreign regulations.
