Diplomová práce pojednává o regulaci právního rámce zpravodajského servisu ČTK. Zabývá se povahou a kvalifikací mediálních produktů agentury, a to zvláště optikou práva autorského. Analyzuje, jaká ochrana je agenturním obsahům právem poskytována, ať již na úrovni jednotlivých výtvorů či při jejich integraci do vyšších systémových celků databází, čímž současně vymezuje i jednotlivá práva jejich tvůrců a povinnosti třetích subjektů, které jsou povinny dodržovat při nakládání s takovým výtvorem. Tvůrčí a jedinečné obsahy před zásahy, ať již ze strany samotných obchodních partnerů agentury ČTK nebo ze strany třetích osob, zastřešuje právní rámec ochrany práva duševního vlastnictví, konkrétně práva autorského. Tržní hodnota informací na mediálním trhu je soukromým právem chráněna právními instituty postihujícími zakázané nekalosoutěžní jednání. Kromě analýzy právní povahy agenturních mediálních sdělení poskytuje práce taktéž čtenáři vhled do problematiky odpovědnosti, konstituované právním řádem pro případ neoprávněného užití servisu ČTK, zasahující jak do sféry práva veřejného, tak soukromoprávní oblasti úpravy. V práci se střetává problematika mediálních studií a s ní provázené otázky právní regulace mediálních aktivit české "továrny na informace" - ČTK.The diploma thesis deals with the regulation of the legal framework of the ČTK news service. It deals with the character and qualifications of media agencies´ products, especially through the lens of copyright. It analyzes what protection is provided to agency content by the law, either at the level of individual pieces of work or when they are integrated into higher system units of databases, which also defines even the individual rights of their creators and the obligations of the third parties which are obliged to observe while handling such piece of work. Creative and unique contents are covered by the legal framework of protection of intellectual property rights, specifically copyright, in front of the interventions, either by the ČTK's business partners themselves or by third parties. The market value of the information in the media market is protected by the private law by legal institutes penalizing prohibited unfair competition. In addition to analyzing the legal character of agency media communications the work also provides the reader with an insight into the issue of liability, constituted by the legal order in the case of unauthorized use of the ČTK service, affecting both public sphere of the law and the private law areas. The issue of media studies and related issues of legal regulation of media activities of the czech "information factory" clash in this piece of work - ČTK.
