Tato diplomová práce pojednává o participačních právech dětí. Cílem práce bylo zjistit, jak jsou v právním řádu ČR upraveny a zda vnitrostátní právní úprava odpovídá mezinárodním požadavkům. Dále jsem se věnovala faktické realizaci participačních práv dětí před orgány veřejné moci v ČR, která vyplývá z dostupných četných nálezů Ústavního soudu ČR. Konečně se práce věnuje možnostem zjišťování názoru dítěte prostřednictvím soudu, znaleckého posudku, zástupce a OSPOD a obsahuje návrhy na změny, které by podpořily lepší naplňování participačních práv dětí.This thesis deals with the participation rights of children. The aim of the thesis was to find out how they are regulated in the Czech legal order and whether the national legislation meets international requirements. Furthermore, I dealt with the factual realization of the participation rights of children in court, which results from the available decisions of the Constitutional Court of the Czech Republic. Finally, the thesis deals with the possibilities of finding out the opinion of the child through the court, expert opinion, representative and OSPOD and contains proposals for changes that would support better fulfillment of children's participation rights.
