Disertační práce pojednává o rozhodování správních orgánů v pochybnostech. Správní orgány rozhodují například pochybnosti, zda pozemek je pozemkem určeným k plnění funkcí lesa, nebo součástí zemědělského půdního fondu, zda věc je odpadem atd. Právní úprava je velmi stručná. Pravidla rozhodování dotváří judikatura správních soudů. Nezohlední-li se však všechny relevantní skutečnosti, včetně stavu pozemku v minulosti, hrozí, že dojde k obejití zákona a užití pozemku k jiným účelům bez legálního odnětí. Tato práce představuje problematiku rozhodování pochybností správními orgány, zabývá se historickými souvislostmi, zahraniční právní úpravou, procesními specifiky i otázkou, nakolik stávající právní úprava může obstát v ústavněprávních souvislostech.This thesis deals with the decision-making of the administrative authorities on the doubts. The administrative authorities decide for example on the doubts whether the land is a land intended for the fulfilment of the functions of a forest or part of the agricultural land fund, or whether a thing is a waste etc. The legislation is very short. The case law of the administrative courts complements decision-making rules. If the relevant facts, including the state of the land in the past, are not taken into account, there is a risk that the law will be obstructed and land used for other purposes without legal exemption. This piece of work presents issue the decision-making of the administrative authorities, it pursues historical continuities, foreign legislations, specifics of the procedural law as well as question what extent the current legislation can stack up to the constitutional connection.
