Diplomová práce se zabývá právní regulací fondového investování do nemovitých věcí a komparací právní úpravy jednotlivých typů tohoto investování. Úvodní část diplomové práce je zaměřena samostatně na nemovité věci a fondové investování. Kapitola pojednávající o investování do nemovitých věcí se soustředí primárně na možnost uplatnění soukromoprávní úpravy nemovitých věcí do veřejnoprávní regulace fondového investování. Kapitola věnující se obecně fondovému investování obsahuje vymezení pojmu fondové investování v kontextu častěji používaného pojmu kolektivní investování a členění investičních fondů. Následně je upřesněn předmět zkoumání diplomové práce pouze na investiční fondy, jejichž hlavním investičním aktivem jsou nemovité věci, a které mohou působit v České republice. Těmito investičními fondy jsou na základě pozitivněprávní regulace speciální fondy nemovitostí, fondy kvalifikovaných investorů a evropské fondy dlouhodobých investic. Stěžejní část diplomové práce se věnuje srovnání těchto tří typů investičních fondů z pohledu různých oblastí jejich právní úpravy. Pro komparaci byla vybrána oblast přípustných právních forem, cenných papírů fondového investování, zdanění investičních fondů, výkonu činností při správě fondů, investiční strategie fondů a do samostatné kapitoly byla vyčleněna komparace klientů fondového investování.The diploma thesis deals with the legal regulation of fund investment into real estate and a comparison of the legal regulation of individual types of this investment. The introductory part of the diploma thesis is focused separately on real estate and fund investment. The chapter which deals with investing into real estate focuses primarily on the possibility of application of the private law regulation of real estate to the public law regulation of fund investment. The chapter devoted in general to fund investment deals with a definition of the term fund investment in the context of the more commonly used term collective investment and the division of the investment funds. Subsequently, the subject of research of the diploma thesis is specified only for the investment funds whose main investment asset is real estate and which may operate in the Czech Republic. Based on the positive law regulation, these investment funds are special real estate funds, qualified investors funds and European long-term investment funds. The main part of the diploma thesis discusses the comparison of these three types of investment funds from the perspective of different areas of their legislation. The area of permissible legal forms, fund investment securities, taxation of investment funds, performance of fund management activities, investment strategy of funds was selected for comparison, and a comparison of fund investment clients was set aside in a separate chapter.
