Diplomová práce se věnuje právní úpravě whistleblowingu a ochraně whistlebowerů se zaměřením na vybrané aspekty zahraniční úpravy. Práce si klade za cíl v úvodní kapitole analyzovat základy problematiky, uvést průniky do ostatních právních odvětví a zaměřit se i na zhodnocení loajality zaměstnance a whistleblowingu. V dalších částech se práce zaměřuje na dosavadní praxi ESLP v hodnocení oznamování protispolečenské činnosti. Dále pak práce analyzuje aktuální návrh zákona o ochraně oznamovatelů a závěrem porovnává právní úpravy v právně příbuzných zemích a vyhodnocuje potřebnost úpravy v České republice.The diploma thesis deals with the legal regulation of whistleblowing and protection of whistleblowers with a focus on selected aspects of foreign adaptations. The aim of the thesis is to analyse the fundamentals aspects of the issue and introduce the overlap into other legal branches and to focus on the evaluation of the loyalty of employee and whistleblowing. In other parts, the thesis focuses on the current practice of the ECHR in evaluating the notification of anti-social activities. Subsequently then analyses the current proposal of Whistleblower Protection Act and in the end of thesis it compares actual legislation in legally related countries and evaluates the requirement of regulation in the Czech Republic.
