Tato diplomová práce se zabývá rozpouštěním politických stran a následně jsou zjištěné poznatky aplikovány na Komunistickou stranu Čech a Moravy, kde je zkoumáno, zda je to legální a demokratická strana, či nikoliv. Práce je členěna do tří kapitol. První kapitola uvádí podmínky rozpouštění politické strany, jak je vytvořil Evropský soud pro lidská práva i Nejvyšší správní soud. V druhé kapitole jsou zjištěné podmínky aplikovány na oficiální dokumenty a výroky členů Komunistické strany Čech a Moravy a pomocí nich je zjišťováno, zda je KSČM legální nebo nelegální stranou a měla by být rozpuštěna. Třetí kapitola je věnována návrhům na změnu právní úpravy rozpouštění politických stran v České republice.The aim of my diploma thesis is to analyze the topic of dissolution of political parties and later the application of the analyzed information on the Communist Party of Bohemia and Moravia. The subject matter is, whether the existence of the previously mentioned political party is legal and democratic, or not. My diploma thesis is divided into three chapters. In the first chapter, there is a description of conditions of dissolution of political party based on the laws provided by the European Court of Human Rights and the Supreme Administrative Court. In the second chapter, there is an application of the conditions described in the first chapter on the official documents, as well as on the statements by the members of the Communist Party of Bohemia and Moravia, in order to determine the extent of its legal or illegal aspects, which should indicate, whether it should be dissolved or not. In the third chapter, there is a list of possible suggestions for the regulation of legislation of the dissolution of political parties in the Czech Republic.
