Předkládaná diplomová práce se věnuje problematice drogové kriminality, se kterou jsou spojena určitá specifika při jejím vyšetřování. Práce je dělena do dvou na sebe navazujících částí. V první části je vymezen legislativní rámec drogových trestných činů v trestním zákoníku. Je zanalyzován vývoj právní úpravy a na konci této části zhodnoceno, zda je aktuální právní úprava k postihování drogové kriminality efektivně nastavena. Druhou část tvoří metody vyšetřování drogových deliktů a jsou vymezena její specifika. Základním kamenem celé mé práce je proces vyšetřování, odhalování a prokazování trestné činnosti v souvislosti s drogami. K tomuto je využívána celá škála procesních institutů k řádnému dopadení pachatelů trestné činnosti. Protože při provádění trestního řízení při jsou využívány prostředky, jejichž provádění je mnohdy způsobilé narušit práva a oprávněné zájmy osob, proti nimž je vedeno trestní řízení, v této práci se snažím dospět k závěru, zda je jejich využití v souladu se základními právy a svobodami a vytyčení jistých ústavněprávních mezí, které v praxi stanovila především judikatura Ústavního soudu ČR.Submitted diploma thesis with the issue of drugs crime with witch sure specificities are associated with its investigation. The thesis is divided into two consecutive parts. The first part defines the legislative framework of drug offenses in the Criminal Code. The progress of the legal regulation is analyzed and at the end of this section the current legislation on the prosecution of drug crime is evaluated. The second part consists of methods of investigation of drug offenses and its specifics are defined. The cornerstone of my entire thesis is the process of investigating, detecting and demonstrating drug-related crime. This is used by a whole range of process institutes to properly capture offenders. Since the implementation of criminal proceedings involves the use of means whose implementation is often capable of interfering with the rights and legitimate interests of persons who are subject to criminal proceedings I try to conclude in this thesis whether their use is in accordance with fundamental rights and freedoms and the establishment of certain constitutional limits which in practice was determined by the case law of the Constitutional Court of the Czech Republic.
