Tato diplomová práce rozebírá problematické aspekty právní ochrany nezletilých při přijetí dědictví. Je členěna do čtyř kapitol. V jednotlivých kapitolách se zabývá zodpovězením otázek, zda přijetí dědictví nezletilými vyžaduje obligatorní schválení soudem dle § 898 OZ, jaké konkrétní problematické aspekty se vážou s jednotlivými způsoby přijetí dědictví ve vztahu k ochraně nezletilých dle § 898 OZ, a dále zda je ochrana poskytovaná skrze obligatorní souhlas soudu efektivním prostředkem ochrany nejlepšího zájmu dítěte ve vztahu k přijetí dědictví. Cílem této práce je konfrontovat tyto problematické aspekty nové právní úpravy s dosavadními názory odborné veřejnosti, přinést nový pohled na danou problematiku a konečně pokusit se otevřít odbornou diskuzi o problematických aspektech, které dosud nebyly diskutovány.This thesis deals with the problematic aspects of legal protection of minors in the event of acceptance of hereditary right. It consists of four chapters. The individual chapters deal with answering questions, whether acceptance of hereditary right by minors requires mandatory approval by a court pursuant to § 898 OZ (Civil Code), what specific problematic aspects are related to individual ways of acceptance hereditary right in relation to the protection of minors pursuant to § 898 OZ, and whether the protection provided through the compulsory consent of the court is effective in protecting the best interests of the child in relation to the inheritance. The aim of this thesis is to confront these problematic aspects of the new legal regulation with the current opinions of the professional public, to bring a new perspective on the issue and finally attempt to open up a professional discussion on problematic issues that have not yet been discussed.
