Diplomová práce je věnována jednomu z negativních doprovodných jevů mírových operací OSN. Jedná se o doprovodný jev sexuálního zneužívání a vykořisťování. Ačkoli se OSN nejrůznějšími prostředky snaží o jeho eliminaci, v současnosti představuje největší zdroj kritiky, který vůči ní směřuje. Práce, se po úvodním vymezení pojmů, věnuje zhodnocení dosavadních kroků, které byly ze strany OSN v této problematice učiněny. S tím souvisí mimo jiné i tvorba relevantních pravidel chování, která jsou určena pro personál mírové operace, a také podrobněji zkoumána v jedné z kapitol. Dále se snaží přiblížit postup v případě podání obvinění ze sexuálního zneužívání a vykořisťování a možné komplikace, jež mohou nastat při aplikaci vhodné právní úpravy. Zabývá se také možností individuální trestní odpovědnosti konkrétních pachatelů a uvádí příklady postihů, jaké mohou být za sexuální zneužívání a vykořisťování uloženy. To vše především ve vztahu k vojenským jednotkám vysílajícího státu.The diploma thesis is dedicated to one of the negative accompanied effects of the UN peacekeeping operations. That is the accompanying effect of the sexual abuse and exploitation. Although the UN is trying to eliminate this effect, by all means, it is currently the biggest source of criticism that the UN is facing. After the definition of the terms in the introduction, this diploma thesis deals with the evaluation of the actions taken so far by the UN. Among other things, this is related to the development of the relevant rules of behavior, which are intended for the peacekeeping operation staff, and that is also examined in detail in one of the chapters. Furthermore the diploma thesis tries to give an insight in case of the allegation of sexual abuse and exploitation and the possible complications that may arise when applying an appropriate legislation. It also deals with the possibility of an individual criminal responsibility of the particular perpetrators and sets out examples of sanctions that may be imposed for the sexual abuse and the exploitation. All this is primary particular in relation to the military units of the sending State.
