Cílem této práce bylo zkoumat, zda jsou možnosti obrany povinného a třetích osob dostačující a zda je excindační žaloba způsobilým prostředkem obrany třetích osob. Úvod práce se tak zaměřuje na zásadu ochrany a obrany povinného a třetích osob a obecné záruky, následuje výklad věnovaný projevům obrany, základním pojmům a stěžejní část práce rozebírá samotnou excindační žalobu. Snahou této práce bylo postupně rozebrat jednotlivé instituty, poukázat na problematické části právní úpravy a tak odpovědět na hypotézy stanovené v úvodu. Práce je členěna do čtyř kapitol, na které navazuje závěr, seznam použitých zdrojů, shrnutí práce a klíčová slova.The aim of this theses was to examine whether there is an adequate defence of the debtor and the third parties and whether the action for exemption is an eligible means of defense of the third parties. The introduction focuses on the principle of protection and defence of the debtor and the third parties, as well as on general liability. It is followed by introducing the concept of defence, other basic concepts and the main part of the work analyses the action for exemption. This work's objective was to present the individual institutes, to point out the problematic parts of the legislation and thus answer the hypotheses stated in the introduction. The theses is divided into four chapters, which are followed by the conclusion, the list of the sources, the summary of the work and keywords.
