Předmětem diplomové práce je právní úprava pěstounské péče a zhodnocení, jak tato úprava chrání práva dětí v pěstounské péči. Pozornost je zaměřena na osobu pěstouna. V úvodu jsou stanoveny problematické otázky a vymezena daná problematika. Následně je uveden institut pěstounské péče, vysvětlen pojem zájem dítěte a jeho souvislost k předmětu diplomové práce. Stěžejní pozornost je věnována právní úpravě v občanském zákoníku. Tato právní úprava je zároveň srovnána se zákonem o rodině. Je poukázáno na změny, ke kterým došlo po rekodifikaci soukromého práva. Jsou rozebrány podmínky a předpoklady pěstounské péče i osoby pěstouna. Dále jsou podrobněji rozvedeny typy osob, které se mohou stát pěstouny. V rámci této kapitoly je poukázáno na kritiku pěstounské péče na přechodnou dobu. Následující kapitoly se věnují procesu výběru pěstouna a kontroly pěstounské péče v jejím průběhu. Pozornost je v diplomové práci zaměřena na české právní předpisy, v menší míře na zahraniční. Je zde obsažena také judikatura Evropského soudu pro lidská práva a judikatura českých soudu. Cílem práce je analýza právních předpisů s ohledem na právní ochranu dětí v pěstounské péči. Diplomová práce je zakončena závěrem, který problematiku shrnuje, a seznamem literatury.The subject of this thesis is the legal regulation of foster care and assesses how these rules protect the rights of children in foster care. Attention is given to the foster parents. At the beginning, the problematic questions are determined and defined for these issues. Subsequently, the definition of the institution of foster care is determined and also explained the concept of the child's interest and its relationship to the subject of the thesis. Crucial attention is given to the legislation in the Civil Code. This legislation is also compared with the Family Act. The thesis points out to changes that occurred after the recodification of private law. Also there is an analysis in terms and conditions of foster care and foster parents. Furthermore, the thesis indicates more details about the types of people who may become foster parents. In this chapter is pointed the criticism of foster care for a temporary period. The following chapters are devoted to the process of selecting foster parents and control of foster care. Attention is given to the Czech legislation, lesser to foreign. The thesis also contains jurisprudence of the European Court of Human Rights and the Czech courts. The aim of this work is the analysis of legislation with focus to the legal protection of children in foster care. The thesis is finished by conclusion that summarizes the issues, and bibliography.
