Práce je zaměřena na postavení svědka v trestním řízení, přičemž se snaží podat ucelený po-hled na toto téma, zejména pak na jeho práva a povinnosti, svědeckou výpověď jako důkazní prostředek v jednotlivých stádiích trestního řízení včetně výslechu svědka mladšího osmnácti let, stěžejní část je pak věnována ochraně svědka včetně zvláštních způsobů ochrany svědka. Práce provádí rozbor současné právní úpravy v České republice, doplněný o platnou českou judikaturu a judikaturu Evropského soudu pro lidská práva, právní úpravu ochrany svědka v Slovenské republice, rozbor diskutovaných témat a úvahy de lege ferenda.The present thesis is focused on the position of a witness in criminal proceedings and tries to outline this topic in its whole. Attention is paid especially to the witness's rights and duties, the witness's testimony as a means of criminal evidence in individual stages of the criminal proceedings as well as to the examination of a juvenile witness under eighteen years of age. The main part of the paper deals with the protection of a witness and the special methods of the witness's protection. The present legal regulations in the Czech Republic completed with the valid Czech jurisdiction, the jurisdiction of the European Court for Human Rights, the legal regulation for the witness's protection in the Slovak Republic, the topics under discus-sion and the de lege ferenda considerations are analyzed here.
